Terms and Conditions
This document sets out the terms and conditions on the basis of which the use of the website www.eurocomitalia.it, which offers a product showcase for urban furnishings, lighting, and playgrounds, is offered to users.
1. Definitions
To allow for a complete understanding and acceptance of these terms and conditions, the following terms, in both singular and plural form, shall have the meanings as indicated below:

2. Scope of Application of the Conditions
The use of the Application implies the User's acceptance of these Conditions.
Should the User not wish to accept the Conditions and/or any other notes, legal notices, or information published or referred to therein, they may not use the Application or its related services.
The Conditions may be amended at any time. Any changes shall be effective from the moment of their publication on the Application.
Before using the Application, the User is required to carefully read and save or print the Conditions for future reference.
The Owner reserves the right to vary, at their discretion, the graphic interface of the Application, the Content, and their organization, as well as any other aspect that characterizes the functionality and management of the Application, by communicating any necessary instructions to the User.

The Content and/or materials available on the website are made available under the terms of the "Creative Commons Public License CC BY 4.0 IT" (hereinafter "License"). The Content and/or materials available on the Application are protected by copyright, other rights granted by copyright law (related rights, database rights, etc.), and/or other applicable laws. Any use of the content and/or materials available on the Application that is not authorized under the License and/or other applicable laws is prohibited.
The Owner grants the User the following rights on the condition that the User agrees to comply with the terms and conditions of the License.
The Owner allows the User to reproduce, distribute, publicly communicate, represent, perform, transform the Content and/or materials available on the Application by any means and format, for any purpose, including commercial use, provided that the User acknowledges the authorship of the work to the Owner and provides a link to the license and indicates if any modifications have been made. 4. Warranty Exclusion
The Application is provided "as is" and "as available," and the Owner provides no express or implied warranties in relation to the Application, nor does it provide any warranty that the Application will meet the User's requirements or will be free from interruptions, errors, or viruses or bugs.
The Owner will endeavor to ensure that the Application is available continuously 24 hours a day, but cannot be held responsible if, for any reason, the Application is not accessible and/or operational at any time or for any period. Access to the Application may be temporarily suspended without notice in case of system failure, maintenance, repairs, or for reasons entirely unrelated to the Owner's will or due to force majeure events.
5. Limitation of Liability
The Owner shall not be liable to the User, except in cases of willful misconduct or gross negligence, for any malfunctions or failures related to the use of the internet network beyond its control or that of its providers. The Owner shall also not be liable for any damages, losses, and costs incurred by the User as a result of the non-performance of the contract for causes not attributable to the Owner. The Owner shall not be liable for any loss of business opportunity and any other indirect loss suffered by the User that is not a direct consequence of the Owner's breach of the contract or improper or unsuitable use of the Application by the Users or third parties. In no event shall the Owner be liable for an amount exceeding twice the cost paid by the User.
6. Force Majeure
The Owner shall not be held responsible for the failure or delayed fulfillment of its obligations due to circumstances beyond its reasonable control, including force majeure events or, in any case, unforeseen and unforeseeable events and, in any case, independent of its will. The performance of the Owner's obligations shall be suspended for the period during which force majeure events occur. The Owner shall take any action within its power to identify solutions that allow for the proper fulfillment of its obligations despite the persistence of force majeure events.
7. Links to Third-Party Sites
The Application may contain links to third-party websites/applications. The Owner exercises no control over them and, therefore, is in no way responsible for the content of these websites/applications. Some of these links may refer to third-party websites/applications that provide services through the Application. In these cases, the individual services will be subject to the general terms of use of the website/application and for the use of the service prepared by the third parties, with respect to which the Owner assumes no responsibility.

9. Applicable Law and Jurisdiction
The Conditions are subject to Italian law.
For any disputes relating to the application, execution, and interpretation of these Conditions, the court of the place where the Owner is based shall have jurisdiction.
